Today the Supreme Court decided the odd, Grisham-like story of Caperton v. Massey — finding that a justice on the West Virginia Supreme Court should have recused himself in an appeal involving a party who spent millions of dollars to put him on the bench. But lost in all the high-power judgery is this fascinating fact: Both the majority and the dissent are pretty worried about judicial bias, the appearance of judicial bias Replica Casio Watches, confidence in the integrity of the judiciary, and what to do about public confidence in human-seeming judges. These are precisely the issues Judge Sonia Sotomayor has openly grappled with in her now-controversial speeches about race, gender, and judging. Indeed, if you read the opinion and the dissent in Caperton alongside Sotomayor’s famous 2001 Berkeley speech, you can’t help but see that she was merely giving voice to the same judicial anxieties aired by the justices today. So perhaps instead of accusing her of racism, bias, and generalized unfitness to judge, we should recognize that she, like her soon-to-be-colleagues at the Supreme Court, understands that talking about bias aloud is ultimately better than whispering about it from the shadows.

In his opinion for the five-judge majority today, Justice Anthony Kennedy—who was more or less born to author this opinion, touching as it does on Big Issues and Public Sensibilities—lays out the “extraordinary situation” in the case: In August 2002, a West Virginia jury returned a verdict finding A.T. The most intriguing aspect of Kennedy’s majority opinion is his meditation on judicial bias, which sounds strikingly like the all-too-public self-scrutiny of Sonia Sotomayor. Like Judge Sotomayor, Kennedy is struck by the process wherein judges attempt to monitor their own efforts at objectivity. He first quotes Benjamin Cardozo: “The work of deciding cases goes on every day in hundreds of courts throughout the land. Any judge, one might suppose, would find it easy to describe the process which he had followed a thousand times and more. Nothing could be farther from the truth.”

Then he writes, in a passage that is strikingly resonant with Sotomayor’s much-maligned Berkeley speech Discount Replica IWC Watches, about how the average judge goes about deciding a case: “The judge inquires into reasons that seem to be leading to a particular result. Precedent and stare decisis and the text and purpose of the law and the Constitution; logic and scholarship and experience and common sense; and fairness and disinterest and neutrality are among the factors at work.” Experience? Common sense? Can “empathy” be far behind?

Sotomayor put it this way in 2001, quoting Judge Miriam Cederbaum: “[J]udges must transcend their personal sympathies and prejudices and aspire to achieve a greater degree of fairness and integrity based on the reason of law. The incongruity is not lost on Robert Perry, legislative director for the New York Civil Liberties Union, which fought for repeal of the Rockefeller laws. “It’s a little ironic that this case involves white folks who are apparently privileged,” says Perry. If anything, their case is a perfect example of why judges should have a broad range of sentencing options—not just prison.

Before 2009, drug felons faced mandatory minimum sentences, depending on what kind of drug and how much they possessed or were selling. Those minimums were requested by the prosecutors, and judges had no option to grant leniency—it was all or nothing. Prosecutors loved this system, since mandatory minimums forced criminals to cooperate in return for reduced sentences. Now judges—not prosecutors—decide sentences, and they can consider various factors, such as addiction, in their decision. If someone seems better suited for a drug treatment center or a rigorous job training program, a judge can choose that option instead of prison.

The Columbia students could be ideal candidates for sentences other than prison, says Gabriel Sayegh of the Drug Policy Alliance. For one thing, their very presence at Columbia shows a certain amount of achievement. Their lawyers could argue that they were young and stupid and made a terrible mistake, but that they shouldn’t be imprisoned. A combination of counseling and community service would get the message across. These students also have a strong support system to fall back on, compared with your average street dealer, which could make nonprison remedies more effective. Lawyers for the students have suggested that some of the students battled addiction, which could justify treatment instead of incarceration. One of the students, Christopher Coles, had a $70-a-day marijuana habit, according to his lawyer. “That’s very much what was intended under these reforms,” says Sayegh.

The students are lucky treatment is even an option. Had they gotten busted before October 2009, when the Rockefeller revisions went into effect, they might all have faced mandatory prison time. Under the new laws, there’s more wiggle room. That said, the Rockefeller revisions aren’t all good news for the students. The reforms eliminated the mandatory minimum for felonies involving small amounts of drugs. (Felons can still be sentenced to prison—it’s just not a requirement.) But they kept in place the penalties on high-level felonies. Four of the students are being charged with B-level felonies, which under the new laws do not carry minimum sentences. But one of the students, Harrison David, faces an A2-level felony charge, which still carries a mandatory minimum prison sentence of three years and a maximum of 10 years. The Columbia bust is hardly the first case to “test” the Rockefeller revisions. Hundreds of drug charges have come through New York courts since 2009. One difference: None of those guys were Ivy Leaguers. But the prestige factor is important. This case could give opponents of the Rockefeller reforms a powerful weapon, says Sayegh. If some of the Columbia students do get a break thanks to the Rockefeller revisions, opponents of the reforms will point to it as yet another example of drug dealers pleading “addiction” to escape tough sentencing. The fact that they’re children of privilege makes it all the worse. Sayegh can already hear the arguments. “Here are these major kingpin drug dealer rich kids; they were selling drugs and involved in criminal activity,” he says, imagining what opponents will say. “And they got off scot free and that’s what these reforms are supposed to do? That’s crazy.”

The Bedroom, USA: I am in a loving relationship with a woman and we’re going on two years. My only issue is that our libidos don’t match. She is fine having sex once a week while my ideal would be everyday, once, twice and maybe three times. We talked about it, and decided to try for once a day. Mobile, Ala.: Recently my children (ages 4 and 2) have been invited to birthday parties for their friends. My children get very excited about going shopping to pick out a gift for their friend(s). They spend quite some time picking out the perfect present. We go to the party and the kids have a wonderful time playing with everyone. Then the time comes around to have pizza and cake then play time is over. The Birthday child never opens their gifts at the party anymore.

Even though my children had a great time playing with their friends, they always ask me why so-and-so didn’t open their present they picked out for them? Did they not like it? Lately the parents haven’t even sent any thank you cards to at least acknowledge that the children actually did open their present.

Has there been some sort of etiquette change that I have not been aware of? Has this become a common occurrence among parents to not let their kid open the presents at their birthday parties?

I’ve had a few discussions with some friends about this and some say they believe it’s a personal preference as some people might think it’s rude to open gifts in front of others. I say I think it’s rude to not open them at the party. Please help clear up the question.

Emily Yoffe: In my childhood the main event of the party was ripping open the presents and having everyone “play” with them until they were smashed to bits. Somewhere along the line that changed because when my (now-13-year-old) daughter started going to birthday parties, I was surprised that the presents were stacked pristinely in a corner of the room and then later we received a thank you note. Why this shift occurred, I don’t know. Of course, at your own party, you are free to let the birthday child open the gifts, but I think it’s a good idea to get the kids in the habit of writing a thank you note—even if it’s a scribble on the card. And the yes, there’s something remiss when you bring a gift even for a toddler and you later don’t get an acknowledgment that the gift is being enjoyed.

Lillington, N.C.: I have two daughters, ages 3 and 6. My husband’s mother has recently moved to the same town as us. Last weekend, she requested my children to come to her house and visit for a few hours. When she came to pick them up, I told her that if they misbehaved, please tell me when they get home and I will deal with them. When she later brought them home, she told me that she’d had to put my 6-year-old on time out and slap my 3-year-old’s hands away from something. It didn’t sound too extreme so I took it in stride.

The next morning, I was getting my 6-year-old ready for church and talking about her visit yesterday. She said she didn’t like being spanked by everybody there. When I asked her who, she said Grandma and a man she didn’t know. I called my mother in law to ask her about this and she said yes, she had “popped” my child and her daughter’s boyfriend (whom I’ve only met twice) had also. I told her I am not comfortable with her disciplining my kids and had not given her permission. She then told me I was out of line and that she was the grandmother. I also requested that she inform me of who would be at the house in the future. The LAT fronts the feel-good story—though perhaps not for some of that 9 percent—of Henry Cejudo, the son of illegal immigrants who won a stunning upset to take Olympic gold in wrestling. For the first time in decades, the Democrat doesn’t need the free media, as Obama has outpaced McCain’s fundraising by wide margins. Obama plans to exploit that advantage. “It’s ‘game on, the money’s in the bank, we’re going to have a huge financial advantage, let the McCain campaign chase us around the country, if they can find us,’ ” Steve McMahon, a Democratic advertising strategist, tells the Times.

The LAT fronts what it calls a so-far “quixotic” effort by some academics to subvert the ruling textbook paradigm. “Anything that stands in the way of the dissemination of knowledge is a real problem,” says Caltech economics professor R. Preston McAfee, a self-described “right-wing economist.” McAfee has written a free online textbook to counter the ever-so-expensive publishing-house textbooks that can now cost students four digits per semester.

Spyker-MF1 has struck a deal with Maranello to use Ferrari engines for the 2007 Formula 1 season. The other week, Slate posed the following question to a group of memoir writers: How do you choose to alert people who appear in your books that you are writing about them—or do you not alert them at all? If you do, do you discuss the book with family members and friends while the work is in progress? How do you deal with complaints from people who may remember events differently than you?

I had trouble with only one person, the considerably younger man whom I describe in My Lives as “My Master.” He had long since dropped me (the subject of my chapter) as a sex partner Bell & Ross Replica Watches, but we remained friends. Like Aston’s other race programs replica watches, it’s F1 campaign will be operated by Prodrive, although the team will actually launch in 2010 as the Prodrive team then switch to the automaker’s branding two years later.

The new team will apparently cooperate with McLaren-Mercedes Beats by Dr Dre, but Prodrive will build the cars at its Banbury factory. The new cars will use customer engines from another manufacturer replica watches, but they will wear Aston Martin badging. The team already has two primary sponsors including Aston Martin majority owner Investment Dar. Prodrive boss Dave Richards acknowledged that the deal to enter F1 was only possible because of the budget caps that are being imposed beginning in 2010.
